The Florida Department of Health implemented sections 381.00771-381.00791, Florida Statutes (F.S.), concerning The Practice of Tattooing. These statutes require licensure for tattoo artists and establishments, and set forth educational requirements and standards of practice for conventional and cosmetic tattoo artists, as well as operational requirements for tattoo establishments. Chapter 64E-28, Florida Administrative Code (F.A.C.), effective September 5, 2012, details these statutory requirements. Tattoo establishment owners, operators, and artists are encouraged to review both the statute sections and the rule chapter to ensure compliance.

Florida Department of Health – Nassau County Environmental Health is responsible for the sanitary and safety requirements related to the design, operations, and maintenance of tattoo establishments and temporary locations within Volusia County. Temporary establishments must meet the same standards as fixed locations and may operate for no more than fourteen consecutive days in conjunction with a single event or celebration.


Tattooing of a Minor

A written notarized parental consent document is required for minors prior to receiving a tattoo. A minor is defined as a person who has not yet attained the age of 18. Tattooing cannot be performed on minors without the notarized consent of their parent or legal guardian. Establishments are prohibited from tattooing individuals under the age of 16.
